Terms and Conditions – Blarney Window Systems

  1. Introduction

  • All configurations and quotations generated by the Service are for informational purposes only and are subject to confirmation by Blarney Window Systems.
  1. Quotations
  • Non-Binding Nature: All quotations provided by the Service are non-binding and subject to final approval. Prices, availability, and terms may change without notice.
  • Quotation Validity: Unless otherwise specified, quotations are valid for a period of 30 days from the date of issuance. After this period, Blarney Window Systems reserves the right to alter the quoted price or conditions.
  • Final Quotation Confirmation: The final price and specifications of the product or service will be confirmed upon receipt of a formal order from the customer and subject to further assessment or clarification of any ambiguities in the configuration.
  • Errors in Quotations: In the event of any typographical or system error in the quotation provided by the Service, Blarney Window Systems reserves the right to cancel or amend the quotation.
  1. Order Acceptance
  • Orders are accepted only after you receive formal written confirmation from us. Any automated or provisional confirmations sent by the Service do not constitute acceptance of an order.
  • Blarney Window Systems reserves the right to reject or modify orders based on the availability of products, inaccuracies in the quotation, or other legitimate reasons.
  1. Image Variation Clause
  • Representation of Products: Images used in the Service, including product configurations and promotional materials, are for illustrative purposes only. While we strive to represent our products as accurately as possible, there may be minor discrepancies between the images shown and the actual product.
  • No Guarantee of Exact Match: Due to variations in screen resolutions, lighting, and image processing, we cannot guarantee that the colors, textures, or finishes depicted in the images will match exactly with the physical product.
  1. Color Variation Clause
  • Natural and Manufacturing Variations: Due to the natural characteristics of materials and manufacturing processes, there may be slight variations in the color, texture, and finish of the products compared to the samples or descriptions provided in the Service. These variations are considered normal and do not constitute grounds for rejecting or returning products.
  • Batch Variations: Products manufactured in different batches may exhibit minor differences in color and finish due to changes in raw materials or manufacturing conditions. We will make every effort to minimize these differences, but they cannot always be eliminated entirely.

  • Payments must be made in accordance with the terms outlined in the final quotation and invoice.
  • All payments must be made in Euro unless otherwise agreed in writing.

  • Estimated delivery times provided by the Service are non-binding and subject to change based on availability, production schedules, and external factors.
  • Blarney Window Systems will make every effort to meet estimated delivery times, but we are not liable for any delays beyond our control, including those caused by third-party suppliers, transportation issues, or unforeseen events.
  1. Warranty and Limitation of Liability
  • Warranty: We warrant that our products and services will conform to the specifications set out in the final confirmed order. Any deviations due to natural variations (e.g., color or material differences) do not constitute a breach of warranty.
  • Limitation of Liability: To the fullest extent permitted by law, Blarney Window Systems will not be liable for any indirect, incidental, or consequential damages arising from the use of our Service, or from any delays or failures in delivering products or services as quoted.
  1. Returns and Cancellations
  • Custom Configurations: Products or services configured to the specific requirements of the customer may not be eligible for return or cancellation unless defective or agreed otherwise in writing.
  • Cancellation Policy: Orders may only be cancelled within 3 days of placing the order, provided no work has commenced. After this period, cancellations may be subject to a cancellation fee.
  1. Intellectual Property
  • The content and materials used in the Service, including but not limited to product designs, trademarks, logos, images, and software, are the intellectual property of Blarney Window Systems and are protected under applicable laws. You may not use or reproduce any of these materials without our prior written consent.
